    Purpose

    Montgomery County Community College is committed to providing a campus environment in which all students have an equal opportunity to learn, study, and grow as scholars and as citizens of the larger community. Students are expected to treat all members of the college community with dignity, respect, fairness, and civility and to behave in a responsible manner at all times both in and outside of the classroom. While fully recognizing every individual student's personal rights, including the right to free speech, the College has established a Student Code of Conduct to describe behavior that is in violation of acceptable college standards and the disciplinary sanctions and disciplinary procedures for code violations. The Code applies to behavior on College owned property, in College classes conducted on campus or at a distance, and at all College-sponsored activities whether on or off campus. Academically related classroom violations will be covered under the College's Academic Discipline Policy.

    Policy

    Section I. Violations

    1. Violation of federal, state, or local laws.
    2. Assault and battery upon another person, or the threat thereof.
    3. Use of verbal, physical, written, electronic, or other means of communication to intimidate, harass (including sexually harass), coerce, or interfere with the rights of other members of the College community.
    4. Lewd, obscene, indecent, or disorderly conduct.
    5. Theft of College property or personal property, either physically or through unauthorized invasion of electronic content.
    6. Willful defacement or destruction of College property or personal property.
    7. Illegal or unauthorized manufacture, sale, possession, or use of alcoholic beverages or controlled substances.
    8. Possession or use of firearms, or other implements commonly described as weapons within the context of the criminal codes of Pennsylvania, or of fireworks, explosives, or dangerous chemicals, unless used in the official duties of a law enforcement or governmental agency.
    9. Obstruction or disruption of teaching, research, administrative procedures, or other College activities.
    10. Tampering with fire alarms or setting false alarms.
    11. Unauthorized entry or use of College facilities, including buildings or grounds.
    12. Deliberate disobedience or resistance, including failing to identify oneself upon request, of College authorities.
    13. Intentionally furnishing false information to the College, or forgery or alteration of the College identification card or College records.
    14. Use of another person’s identification to gain access to College facilities or resources (physical or electronic).
    15. Use of any computer or electronic resource for private or personal business or for any purpose which is inconsistent with the mission or instructional needs of the College.
    16. Violation of copyright laws.
    17. Violation of other College Policies & Procedures.

    Section II. Sanctions

    Violations may result in one or more of the following:

    1. Disciplinary Warning

      Written notice to the student that the conduct in question is in violation of a specified regulation of the Code of Conduct and warning that future misconduct could result in more severe disciplinary action. Disciplinary warning may be issued by the Vice President for Student Affairs & Enrollment Management without the right of appeal or disciplinary hearing.

    2. Disciplinary Probation

      Disciplinary Warning with the added stipulation that if the student is found guilty of a violation of the College's Code of Conduct during a specified probationary period, the student's continued enrollment at the College will be in jeopardy.

    3. Interim Suspension

      Temporary exclusion from the College pending results of a disciplinary hearing conducted within seven (7) calendar days of the effective date of the interim suspension or as soon as practical. This sanction is to be invoked by the President of the College only when the presence of the student on campus poses a threat of harm to the student, to others, or to the continuance of normal College functions.

    4. Disciplinary Suspension

      Exclusion from the College for a specified period of time. Upon completion of the period of suspension, the student will be considered for readmittance in accordance with the academic admission standards that are in effect.

    5. Disciplinary Dismissal

      Permanent exclusion from the College.

    6. Removal from Classroom

      Immediate exclusion from the classroom, to be invoked by the instructor when the presence of the student in the class poses a threat of harm to the student, to others, or to the continuance of normal classroom functions. Depending on the gravity of the violation, Public Safety Officers or local law enforcement officers may be notified. Incidents should be reported to the Vice President for Student Affairs and Enrollment Management as violations of the Student Code of Conduct.

    7. Restitution

      Compensation for loss, damages, or injury to, or misappropriations of, College property or the property of members or of visitors to the College.

    8. Alternative Sanctions

      Additional or alternate sanctions, including, but not limited to, restrictions on participation in certain College activities, oral or written apologies, attendance at counseling sessions, and/or participation in College or community service.
